Money money money.

Extension to money money money.

I am a Malaysian citizen, Muslim, Bumiputera and a taxpayer. I sure want to know how the government used my tax money. If it has being misused for some personal gain by any individual, I declare that I will not forgive the individual and see you at Allah’s Court of Judgment. You can bring in as many lawyers as you can to defend you, even the famous Malaysian Attorney General can come in between. Mind you, in this Court you cannot choose the Judge. I would redeem my money. The money I earned is my blood and sweat.

Quote:

PKFZ part II - Its money........my money.

1. The more I read about the PKFZ report, the more upset I become. I realize that the PW report was probably adulterated to a certain extent to minimize the impact to the readers. There is probably a lot of information that was not taken out by the owner of the report. After all PW made the report for the KPA and it is entirely up to KPA to decide on what can or cannot be released.

2. I had mention in my first write up that the scale of the problem could probably the tip of an iceberg. There might be some truth in it but I was merely speculating. I speculate because there I have a strong distrust of my present government. At the same time my speculation is supported by the previous history of financial mismanagement on the part of the government.

3. Let us revisit some of the projects that I can remember. Like many Malaysians, there are probably so many glaring financial scandals but we have forgotten. In the 90s, we had the MAS fiasco of selling 30% share of MAS to TRI for RM1.8 bill. TRI runs the company for few years, splits it into piece meal and then sold some of it. MAS subsequently continue its losing streak that accumulated to about RM 6 billion.

4. The government then spent RM1.8 billion to buy back the 30% shares from TR. When the government sold MAS, it was a profit making company with healthy balance sheet. When they buy it back it was a loss making and was at the verge of collapsing. By the time it came into IdrIs Jala hands, it has loss another RM 3 billion. All in all, the MAS saga cost the Malaysian people an estimated amount of RM10.8 billion and MAS today do not own planes and has also lost the

5. In the case of the Navy Ship procurement involving Amin Shah and PSC, it cost the government about RM25 billion and only half of the ship ordered was delivered. Proton, MISC, KPB and several other GLC loss substantial amount of money. This has not included the abandon government buildings, schools, hospitals etc. All in all, I would not be surprised if in the last 15 years Malaysian has loss more than RM 100 billion.

6. Ever wondered what we can do with RM 100 billion. The North South Highway cost RM4 billion to build. In other words we could build 25 highways. On average a school cost about RM 10 mill. That is an equivalent of 10,000 schools. We could give Malaysian scholarships to about 5 million Malaysians. If we decided to buy SU 30 at the inflated price including profit (RM1.8 bill for 12 units) we would have 667 aircraft. This would have made us a super power in Asia. Mind you, that is a conservative number.

7. What we see is that inefficient government and people with the right political connection capitalize on the opportunity. How long must this continue? How much nonsense can the people tolerate? The government that people tolerated over the years may just finally face the brunt of the people. This has to stop. Only the people can stop this nonsense.

8. The government is essentially a group of elected people. We can replace the whole BN bunch but there is no guarantee that the new group of people will not abuse the system. Every single adult Malaysian who closes one eye is an accessory to the crime. We need to change. We live in the era where it is probably the easiest era where the people can exert check and balance.

9. In the world of IT today, Malaysian can scanned documents and other evidence and upload them on the internet for the public to view it. Uploading can be done anonymously. Similarly information or evidence can be disseminated via anonymous email that can spread to millions within hours. With evidence in the public, no guilty party can deny and hide. No one with power would want to help as it can be seen as an accessory to the whole crime.

10. The honest and brave few at every level of the society is the probably our last hope to provide the necessary check and balance. Before the era of internet, free emails and document storage it is relatively difficult for people to take out documents. Today the scenario is different. This brave few can nip financial crime at its bud. Indirectly, the regulated MACC will be on their toes.

11. I am really upset about this whole issue. A few billion here. A few billion there and the Malaysian Government coffers is being drained indirectly. Someone told me to take it easy as it is only money… Yes its only money… MY MONEY!

My gain.

I have 43,560,000 square feet of land for development. I bought the land from somewhere (not willing to disclose). I bought it cheap at RM 3.00 per sq ft. Sometimes last week, one big conglomerate approached me and wanted that piece of land. I now decided to sell at RM 25.00 per sq ft. My profit margin is RM 22.00 per sq ft.

Wow!!! That’s big money.

I would make the following profit:

43,560,000 sq ft X RM 22 = RM 958,320,000.00 (Nine hundred fifty eight million, three hundred twenty thousand).

With this amount of money, my next seven generations would live happily from my manipulation. Don’t ask me to whom I sold the land to. If you want to know, go and find out yourself.

I wish I could say that and I really owned that piece of land. Just for the land transaction alone, that amount of money can be made. What if the contract given to me to develop that piece of land? I certainly would make more money.

Money, money, money.

Disappointed.

European Cup Final: Manchester United played against Barcelona at Rome Olympic Stadium. MU was in white and Barcelona with their official colored jerseys. The world was watching this game and telecasted live to 162 countries.

My prediction was MU to win the trophy and fielded the same starting line up as the second semi final against Arsenal. This proved to be a wrong calculation. MU was to defend the Cup which they won last season. During the first nine minutes, MU was controlling the game and nearly scored from a 32 meter free kick by Ronaldo. The first chance by Barcelona to see MU goal was at the 10th minute and ended with a goal by Samuel Eto’o. From there on, it was Barcelona all the way and MU was out of rhythm. The first half ended with Barcelona with one goal up.

Starting of the second half, Carlos Tevez came in and I had high hope MU equalizing. It was not to be, as at the 70th minute, Messi created a mess for MU and scored from a beautiful header. Barcelona was two goals up and what they did was to control the midfield by short accurate inter passes from there on for the last 20 minutes of regular playtime. Barcelona goalkeeper could take a rest while the MU counterpart was busy preventing further embarrassment.

The game ended with Barcelona 2 and MU 0. I went to bed disappointed.

An encounter with the CEO.

Late 1989 I had the opportunity to visit Guthrie USA main office at Tuscon Arizona. On the last night of my visit I was invited by the President, Dick McCoy for dinner at his beautiful mansion overlooking the Arizona desert. I waited at the Hotel lobby and the Vice President Ted Pressler arrived in a chauffeured limousine. My first time in an American limo and I thanked Ted. Ted said not to worry as Guthrie was paying. Ted, Gula (Ted’s girlfriend) and me made our way up the mountain slope. The night scenery of Tuscon down below was fantastic as we maneuvered and we sipped wine along the way.

Dick was at the door step to welcome me and being Malay I wanted to take off my shoes as I entered the hall. I forgot I was in an American home and you do not need to take off the shoes. We had dinner and Mrs. McCoy acknowledged that she had a Muslim guest and she did her best to prepare as halal as possible. After dinner we adjourned to the bar for casual and light business discussions. At one instant, I told Dick I was not feeling comfortable in his home. He was shocked and laughed when I told him I was not used to wearing shoes in a house. Ted and me downed several bottles of beer but Dick was on whisky and he had one too many. He began to run out off topic. I had to control myself as I did not want to misbehave. I was upright but a little groggy when we left Dick’s mansion sometimes around midnight. No wonder Ted Pressler ordered the chauffeured limousine. The seven footer Mat Salleh chauffer opened and closed the door for a five footer Melayu.

One week later there was a Board Meeting in Tuscon and all the Malaysian Directors and the CEO was present in Tuscon. Dick did not keep his mouth shut and he told Tan Sri Ani Arope about my last week visit and related to Tan Sri that the guy could hold his drinks well and preferred him to work with Guthrie USA.

When the Board members came back to Malaysia I had two calls, one from the Marketing Director and the other the Plantation Director. The Marketing Director, my Boss told me that I would not be transferred to US as per Dick request. The Plantation Director told me that Ani Arope would like to know who the Malay Muslim Mat Salleh based at Port Klang? Finally Tan Sri Ani Arope knew who I was when I was singled out by the Plantation Director to pose a question to the CEO during a luncheon gathering at Tropicana Golf Club.

To cut the story short, the Muslim Mat Salleh was transferred to Wisma Guthrie in Damansara as Distribution Manager on 1st. August 1990. It was customary for newly transferred Manager at Wisma Guthrie to have lunch with the Board of Directors after the monthly meeting. I was not spared and Tan Sri Ani Arope was waiting for the opportunity. It was a buffet lunch and as I was queuing among the Directors, Tan Sri commented that they don’t served beer for lunch only sky juice and orange juice available. I knew it was meant for me. Tan Sri purposely invited me to sit right beside him and honestly I did not enjoy my lunch. Tan Sri was relating stories during his younger days when he played prank to a drunkard toddy drinking Indian. I knew he wanted to get the message through to me.

Tan Sri Ani Arope hates drinkers and smokers and I was having both. Being in Marketing Division I had to socialize a lot, meeting clients and potential clients. I am what I am and I am no hypocrites or angels. I just don’t smoke and drink in front of Ani Arope, that’s all.

During Tan Sri Ani Arope farewell gathering, Tan Sri came up to me personally touched my left chest and asked me to look after what is inside. I acknowledged his concern with thanks.

Tan Sri Ani Arope left Guthrie but I would always remember the luncheon bashing. Looking back it was just an indirect advice with sincerity from someone senior. In October 2003, I had a mild stroke. Perhaps Tan Sri Ani Arope was right.

Note:

1. Tan Sri Ani Arope – the CEO, now retired and I heard he had taken up flying.

2. Dick McCoy – President Guthrie USA, passed away in Bangkok.

3. Ted Pressler – Vice President Guthrie USA, now became an Archeologists.

4. How Wan Hong – Marketing Director, retired and resides in Taman Tun Ismail.

5. Ismayudin Manan – Plantation Director, a Director of DRB Hi Com and resides at Staffield Country Home in Nilai.

6. Mustapa Hamid – the Muslim Mat Salleh, retired and hibernating at Kampong Raja Uda, Port Klang.

Turmoil around us.

Pakistan: About 2 million people from the North Western front are displaced. They are running away from the government and American bombardment of the War on Terror on the Taliban. The refugees are living in temporary shelters with lack of basic amenities and their daily life interrupted. The world is feeding them.

Mynmar: Typhoon Nargis victims still did not get the proper aid to repair their damaged houses or shacks. What they got was only plastic sheet to cover the roofing. Nargis struck a year ago and the victim living conditions are deteriorating. The government is only interested and damn busy prosecuting Su Kyi for allowing an American sneaking into her prison home. The Muslims, the Rohingya being oppressed are running out of the country by land and boat. Some drowned at sea on the way to Aceh, Indonesia.

Sri Lanka: The Sri Lankan Tamils is in disarray. They become refugees running away from the Tamil Tiger hot spots. They are just ordinary Tamil, maybe a Tamil Tiger sympathizers or otherwise. The government artillery had been accused of bombarding innocent Tamil. The world is supplying food to the displaced Tamils.

Thailand: A red, yellow or blue colored T shirt demonstrators may just appear in the city of Bangkok when you least expected. Southern Thailand - places to avoid are Yala and Narathiwat province. Damn hot area, the Muslims are unhappy how they are being treated. Snipers can be anywhere. Even Golok is not spared and the insurgent capable of planting bomb at an old abandoned motorcycle.

North Korea: They performed underground nuclear test and launch short/ long range missiles. North Korea had pilferage UN resolution. The UN cried foul and would impose new Resolutions against North Korea. What the heck? Israel had blatantly broken several UN Resolutions but no actions taken against Israel. Why the double standards?

Bangladesh: Go to any town or cities in Malaysia, we are bound to bump into a Bangladeshi. They are plentiful and being employed in most sectors, construction, industries and eating places. They can easily assimilate with the crowd as local Mamak.

Nepal: They recently kicked out their King. This mountainous country is only beginning to feel and learn what democracy is all about but still unstable. They were worriers in the British Army and known as Gurkhas. Brave and dedicated people and mostly imported in Malaysia as Security Guards. Life back home in Nepal offers less job opportunity except becoming Shepars for Everest climbers.

India: The largest democratic country in the world and one of the fastest economic growths in Asia. The country is too populated, a billion people and counting. The Indians are brainy on information technology and that Silicon Valley in US is made up majority of Indian experts. India are still at war with Pakistan on the Kashmir issue and both countries pointing their missiles warheads against each other. The distance between the rich and poor is too far apart and the caste system is still in place. Aren’t human being are born equal in the eye of God?

Back Home: Democracy in Perak determined by the Court, not by the people. In Perak, if you wear black, the policemen in blue would arrest you. Every private assembly more than three people, requires a permit. Do you need a permit to play mahjong? Everything is two in Perak. There are currently two Menteri Besar and two Speakers in Perak until the Federal Court decides. At the national level there are two Presidents in one of the component ruling party.

Penanti.

The incumbent Assemblyman from PKR cum Penang Deputy Chief Minister 1 tendered his resignation to make way for a bye election. Mohd Fairus was in the midst of speculation that he had taken bribe from a quarry. The Anti Corruption Agency was hot on his heel. They even detained him at the Immigration checkpoint at Johore Baharu when Fairus entering Singapore.

Once Fairus tendered his resignation BN had to face another bye election and the most feared challenger would be PKR. Penanti is one of the three constituents of Anwar’s Parliamentary playground. All of a sudden, the Anti Corruption Agency declared that there was no case against Fairus and Fairus could retract his resignation. Fairus stood his stand and a bye election had to proceed. What if Fairus did not resigned? The ACA would pursue the case, find him guilty and embarrass PKR to the nation. In this case Fairus had outsmarted BN. He embarrassed BN instead. The ACA cannot retract their declarations that Fairus is clean. BN walked off with their mouth opened.

BN was in dilemma. They were contemplating. To stand would be another loss to BN. Mahathir advised them to stand but Najib who just got his Premiership cannot afford another loss and backlash from the rakyat. Finally BN decided not to stand giving the excuse the bye election is only PKR plan propaganda. The Penanti bye election does not arise from the Constitution requirement. Penanti is not a safe place for BN. Najib lame excuse for not contesting the bye election is to save money for the country’s economic well being.

Nomination was held on 23 May 2009 and BN stayed away. Chicken!!!. My perception: BN is damn scared of a bye election. The rakyat is not supportive of their political ideology anymore. One clear indication when Manoharan one of Selangor Assemblyman detained under the Internal Security Act threatened to resign, he was released a week later. Here too, BN wanted to avoid a bye election and is a confirmed slaughterhouse. With the present fiasco BN had created in Perak the rakyat is just plain fed up to the bone and the consequences would be beyond redemption.

Unless BN do something miraculous before the 13 General Election, the sun would forever set upon them. Ask any non UMNo supporter and cronies in the streets, the answer is no no to UMNo.

Third Bridge.

Sometimes in 2005 I took a trip to Batam Island vide ferry from Tanjong Puteri in Johore. It was a nostalgic ferry ride because in 1976 I had taken a speedboat from Pasir Gudang to the Immigration checkpoint at Johore Baharu. There was vast change along the way and when passing the Pasir Gudang Oil Jetty it brought back memories of my days at Pasir Gudang from Dec 1974 to July 1977. The Jetty had expanded and they had installed cranes compared to my days when we had to haul the hoses manually to the ship’s manifold. I had worked on this Jetty through rain and shine, day and nights. Working with ships is a twenty four hours affair.

The ferry passed through Pasir Gudang and cruised by the Singapore side of the Johore Straits. I was amazed when I saw Pulau Tekong Kecil and Pulau Tekong which belong to Singapore had been vastly expanded through reclamation and getting nearer to mainland Singapore. I began to wonder what is Singapore has in mind for these development. My best bet Singapore would want to develop the islands as a port and consequently build a bridge connecting mainland Singapore to the islands. From Pulau Tekong Kecil or Pulau Tekong, Singapore would then propose a bridge connecting mainland Malaysia probably at Kota Tinggi or Desaru.

My prediction came true on 22 May 2009 when the Prime Minister of Malaysia met his counterpart, the Prime Minister of Singapore. A third bridge was proposed on the eastern side of both countries. No wonder Singapore refused to upgrade the Causeway.

On this aspect I think late Tun Razak make a blunder for developing Pasir Gudang as a Port. Why didn’t he think of Tanjong Pelepas then? Mahathir was smarter by having a crooked causeway in mind but Abdullah Badawi scrapped it. Singapore Premier mentality is always one step ahead of ours.

The third bridge would be built but Johore Baru would remain chaotic. The third bridge is for whose benefit? Malaysians or Singaporeans? The water near the causeway would remain stagnant and polluted. Whatever….before the third bridge to be considered, the causeway should be sorted out.

Expected.

Nizar was declared as the legal MB of Perak. Zambry went an appeal to throw off the Judgment and Nizar re appeal to throw off Zambry appeal. Three Judges met on 22 May 2009 and threw off Nizar re appeal. So Zambry is the legal MB of Perak so said the three Judges. The verdict was expected however disappointed.

I got the information that Nizar would no way be the MB of Perak from my brother somewhere in Perak who is a very close associate with one of the UMNo Wakil Rakyaat and a state Exco. When Nizar declared as the legal MB of Perak, he told me that Zambry would appeal and the MB position would stay firm with Zambry. Just watch and wait, he said. From this source, I believe it was all plan and orchestrated.

The next move, Nizar would appeal to the Federal Court. In my opinion it is a waste of time and money. PR and Nizar can never win in Court. We just have to wait for the Rakyat judgment at the coming 13th General Election. Just be patient and we will teach those people what fair governance is. What goes up must come down. Every dog has its day.

Circumcision.

It was a school term holidays in 1959 in a month of Ramadhan. It was about 5 in the evening and I was out playing with the other kids in front of the house in Taiping. My father came back from the office and told me after the breaking of fast we would be going to the Hospital for my circumcision. Suddenly my mood changed and I stopped playing. I headed for the staircase and ponder how I was going through the night. It was a short notice and I was not prepared to face the knife. I was very scared because I was never been hospitalized before. I was a kampong boy staying with my grandparents. Some of the boys who had been circumcised came around, related to me their ordeal and I felt I was just like facing the gallows. My father assured me Dr Raja Abdullah would be around and not to worry.

After the breaking of fast, my father took me to the Hospital and I was ushered into the room. Dispenser Haji Ismail was waiting and he was going to perform the cutting. My brother Jamaluddin accompanied me but he remained outside the room. I did not know where Dr Raja Abdullah and my father went to. I was asked to lie down and Haji Ismail performed the surgery. There was no anesthetic and the pain was horrible. I remember I cried in pain but Haji Ismail had no mercy on me. It was over in about half an hour but to me it was an agony of three hours.

When it was over it was still paining but the consolation I had been circumcised and now it’s my turn to scare off the other boys. I suffered for the next one week until the wound completely healed. Pain killer was not known then and for one week I walked like a “king kong”. When the school term about to end, my father sent me back to the kampong and from then on I could pray along with the kampong elders. I entered adulthood and the most fearful obstacle of any Muslim boys had been conquered.

My grandparents were shocked as they had planned a big ceremony for their grandson’s circumcision. It doesn’t matter to me anymore. I had crossed the obstacle.

I was the first boy in the kampong to be circumcised in a Hospital. Whenever I am in Taiping, I always remember the Hospital and the Dispenser, the late Haji Ismail.

Sri Lanka.

I congratulate the Sri Lankan government for the successful victory against the Tamil Tigers. Sri Lanka is populated by majority Sinhalese Buddhist and the Tamil Hindus are minority. For the past 30 years the Tamils Tigers had been harassing the country and civil war erupted. Along the line, thousands of lives perished both from the line of fire. Million was displaced and became refugees. Many were wounded and those who lost their love one, suffers mentally. Is it worth? Who actually gain? To me, it’s the bloody Arm and Ammunition Suppliers.

Sri Lanka is a God bless island nation. When God banished Adam to earth, He chose Sri Lanka formerly known as Ceylon. Adam set foot on Sri Lanka and made to sought for his other half, Eve who was dropped at the Arab Peninsula. They finally rendezvous at Mount Arafat and from there on the human race multiply.

The aim of the Tamil Tigers was to form a state within a state in Sri Lanka. The Tamil Tigers are comprised of Tamil Hindus and I am surprise why the world branded them as Tamil Tigers. instead of Hindu extremists like they term Islamic extremists. I wonder who supply the arm to the Tamil Tigers and where do they get their fund? I fully agree that the world branded the Tamil Tigers as terrorists because they took arm to terrorize the population. The Tamil Tigers are trying to occupy and overrun a democratic elected government. They chose to boycott the last election.

Though the ring leader and Commander in Chief of the Tamil Tigers, Vellupillai Prabakaran had been killed as shown by TV footage around the world, I fear that the splinters who survived the government onslaught may maintain the ideology and regroup. Terrorism vide arm and ammunition not necessary can solve any conflict especially when human lives are at stake.

I wish to see the Tamils and the Sinhalese can live in peace side by side in the God bless island nation of Sri Lanka. The tea plantations and the all round beautiful beaches can enhance the country economy. A peaceful country can attract tourists from all over the world.

As reference and understanding of the conflict.

Quote:

The history of the Tamil/Sinhalese conflict.

A long-standing rivalry between Tamil and Sinhalese inhabitants of Sri Lanka has ensured an extremely volatile relationship between the two groups. The combination of religious and ethnic differences continues to create violent conflicts between the parties although they have shared Sri Lanka for innumerable centuries.

The Tamil minority originated from India, immigrating to Sri Lanka between the 3rd century B.C. and the 13th century A.D. Making up a small portion of the population, Tamils constitute almost the entire Hindu population of the land. In the 5th century B.C., Indo-Aryan emigration from India created the Sinhalese population in Sri Lanka. It still holds the majority today and thus, much political power. The greater part of the Sinhalese populace considers itself to be Buddhist. Religious tension intensifies the struggle for supremacy between Tamils and Sinhalese.

Prior to colonial occupation, Tamils controlled the northern part of Ceylon (renamed Sri Lanka in 1972), while the Sinhalese ruled the southern regions of the land. In 1505, the Portuguese took control of the country and began its history as a colonial settlement. Throughout its relationship with the west, Sri Lanka has been dominated by world powers that have their prevented self-rule. Finally, in 1948 Sri Lanka gained independence and thus, sovereignty over its lands. Prior to this momentous occasion, Tamil and Sinhalese forces combined to fight for their common freedom. However, this alliance did not last long.

The Sinhalese have retained power throughout most of Sri Lanka's history because of its size compared to the Tamil population, the second largest group in the country. With unquestioned economic and political power, the Sinhalese inhabitants face the anger and bitterness of the minority Tamils, who must struggle to have their voice heard. Conflict between the Tamil and Sinhalese rose to a new degree in 1956 as Solomon Bandaranaike was instated as Prime Minster and declared Sinhala the official language of what was then Ceylon. The Tamil minority was outraged by this act and opposition to the Sinhalese dominated government grew as the state backed Buddhism on an official level. Bandaranaike was later assassinated and proceeded by his wife who became Prime Minister in 1960. In 1983 civil unrest could no longer be contained and the country broke out into civil war.

HRH Sultan and Nizar.

I am getting more confuse now.

QUOTE:

KUALA LUMPUR, May 18 — Sultan of Perak Sultan Azlan Shah cannot dismiss Datuk Seri Mohammad Nizar Jamaluddin from his office because the latter (mentri besar) does not hold office at the pleasure of the ruler.

This is the ruling of High Court Judge Datuk Abdul Aziz Abdul Rahim when he declared Mohammad Nizar as the legitimate Mentri Besar of Perak on May 11.

In his 78-page judgment released to the media today, Abdul Aziz said once a mentri besar was appointed, he and his executive council were answerable to the State Legislative Assembly and to no one else.

He said this was so under clauses (2), (5), (6) and (7) of Article 16 of the Perak State Constitution.

“Once a mentri besar is appointed, the mentri besar governs the state through the Executive Council and advises the Sultan on the affairs of the state provided under Article 18 (1) of the Perak State Constitution.

Justice Abdul Aziz said the Sultan would then act upon the advice except in matters where the Perak State Constitution provides that his Royal Highness may act in his own absolute discretion.

He said based on the provisions in Article 16, the said Article requires that the legislative assembly be the one to determine whether it has confidence in the mentri besar as the head of the executive council through a vote of no confidence against the mentri besar.

“It is my opinion that the dismissal of the mentri besar by His Royal Highness or by anyone else is never contemplated under Article 16 (6) of the Perak State Constitution,” he said.

He said clause 7 of Article 16 of the Perak State Constitution provided that except for the mentri besar, other members of the Executive Council held office at the Sultan’s pleasure and they (the executive members) may be removed from office by the Sultan acting on the mentri besar’s advice.

Abdul Aziz said the Sultan of Perak had met and interviewed the three state assemblymen who turned independent and another assemblyman who earlier quit Barisan Nasional (BN) but rejoined and they had informed the ruler that they had pledged their support for BN voluntarily without any coercion from any party.

Abdul Aziz, however, said although through the Sultan’s enquiries, His Royal Highness had judged that Datuk Seri Dr Zambry Abdul Kadir had the support of the majority of the members of the state legislative assembly, it did not mean that His Royal Highness could form an opinion that Mohammad Nizar had ceased to command the confidence of the majority of the assembly.

He said the Sultan’s personal opinion or judgment was irrelevant to the construction of Article 16 (6) which provided that “if the mentri besar ceases to command the confidence of the majority of the members of the legislative assembly, then, unless at his request, His Royal Highness dissolves the assembly, he shall tender the resignation of the executive council”.

Abdul Aziz heard the judicial review proceedings initiated by Mohammad Nizar, 52, seeking for a writ of “quo warranto” to be issued against Zambry to show cause on what basis or authority that he (Zambry) was the rightful mentri besar.

He then declared Mohammad Nizar as the rightful mentri besar after ruling that he (Nizar) had not vacated the office of mentri besar since he had not lost the confidence of the majority of the state legislative assembly.

Mohammad Nizar, was appointed mentri besar on March 17 last year after the DAP-PKR-PAS alliance won 31 seats in the 12th general election.

Both sides, however, have 28 seats each in the 59-seat assembly after three assemblymen from the alliance quit their parties to become independents and the fourth jumped back from PKR to Umno.

Sultan Azlan Shah then asked Mohammad Nizar to step down as mentri besar and swore in Zambry after declaring that Barisan Nasional had the majority in the state legislative assembly.

The Court of Appeal, on May 12, granted a stay order to Zambry and has fixed this Thursday for hearing together with Mohammad Nizar’s application to set aside the stay order.

In his written judgment, Justice Abdul Aziz also said he had no doubt that the Sultan has absolute discretion with regard to the appointment of mentri besar and the withholding of consent to a request for the dissolution of the state legislative assembly.

“I never had any doubt that the exercise of royal prerogative to appoint a mentri besar pursuant to Article 16 (2) of the Perak State Constitution is solely based on personal judgment of His Royal Highness.

“And that His Royal Highness may resort to any means in order to satisfy himself and accordingly to form his judgment as to whom who is likely to command the confidence of the majority of the state legislative assembly that he can be appointed as the mentri besar to lead the executive council,” he said.

Abdul Aziz however said the same thing cannot be done with regard to Article 16 (6) in deciding whether the mentri besar ceases to command the confidence of the majority of the members of the legislative assembly.– Bernama MI

Which lawbook and constitution should we actually refer to and who is interpreting the law and the Constitution?

I will keep on waiting for the the latest development. Que sera sera.

Perak prediction.

Just my prediction

No way, Perak Assembly would be dissolved. My indication: BN did not want to contest the Penanti election. To them it is going to be a waste of money and the money can be utilized to revitalize the economy. If that is the case and the excuse there is no way the Perak assembly would be dissolved because it would involve a lot of money for SPR to conduct a reelection for the whole state of Perak.

My best bet, the present state assembly would convene an emergency sitting and the BN + 3 frogs would override the 28 PR assemblymen. A vote of no confidence would be set upon Nizar, the right way to dispose him according to the Constitution and Nizar and his PR government would seem collapse.

However, it does not sound that easy. Several court cases still pending. Was the force eviction of PR Speaker on 7 May sitting was legal? Counter appeal by Nizar is in progress and PR Speaker versus BN Speaker. The Judiciary is not on PR camp and more often than not the Judiciary would favor BN. That’s the name of the game. Head I win, tail you loose. BN can interpret the law to their whim and fancy.

The majority of Perakians and Malaysians in general prefer for a reelection so that Perakians can decide who is Perak Administrator of the day. That’s the best solution to unwind the mess. If BN dare not contest the Penanti seat, I don’t see they dare to dissolve Perak State Assembly.

BN, please prove me wrong.

Saleh Ibrahim.

Sunday 17 May 2009, received a sms from my wife’s nephew that his father was in critical condition at ICU Klang Hospital. After the zohor prayer, I rushed to the Hospital and he was all hooked up with all the medical instruments and monitors. All his children were there and I was allowed into the ICU to be at his bedside. Probably the Doctor in attendance knew that there was no hope. I glanced at the Blood Pressure monitor and I noticed it was damn low.

I arrived at 1445 hours and the Doctor confirmed that he was gone at 1535 hours just after I came out from the ICU. Haji Saleh Ibrahim aged 75 died due to several complications, kidney, sugar and heart problem. He was on dialysis for the past several years. By 1720 hours his body was laid at his residence for relatives and well wishers from near and afar paying the last respect.

Manchester United - BPL Champion.

Season 2008/2009 MU retained the Barclay Premier League Cup at Old Trafford after holding Arsenal to a draw. MU hosted Arsenal at Old Trafford and the mission was just a point to topple Liverpool who is having two games to play. The game ended with scoreless draw 0-0 and Liverpool hope was shattered. Sorry Rafael and well done Sir Alex Ferguson.

The rest of the league is to determine the ranking in the table and the three teams dropping out from the Premier League. Whatever, Manchester United top the table and the Champion.

My hope for next season for MU: Carlos Teves retained and Ronaldo does not return to the Continent.

The Perak debacle.

Another interesting article worth copied and paste for future reference.

Quote:

There must have been a valid reason for stating that the law is an ass. Now we understand why it is so. The open-handed stay order granted by a single judge – Datuk Ramly Ali - of the Court of Appeal confirms why the law is an ass.

By P. Ramakrishnan, President (Aliran)

On May 11, 2009 High Court Justice Abdul Aziz Abdul Rahim in a well-argued judgment declared that Datuk Seri Nizar was the duly appointed Menteri Besar at all material times and that Datuk Seri Dr Zambry was never the MB of Perak at any material time. In other words, Zambry has no business to be or pretend to be the MB of Perak.

The High Court decision had positively removed all doubts and confusion as to who was the rightful and legitimate MB of Perak.

The next day, May 12, 2009 Ramly muddied the water by granting the stay order to the High Court decision without any conditions. This decision confounded the nation and left everyone dumbfounded.

As a result of this absurd decision of Ramly, the position of the genuine MB has been undermined and has left him in a limbo unable to discharge his duties and serve the needs of Perakians.

But on the other hand, the stay order seems to have given the man who never was the MB of Perak at any time whatsoever a second lease of life to occupy the MB's chair.

This ridiculous situation has bewildered every thinking Malaysian into a state of utter confusion .

If Ramly had granted a conditional order restraining both Nizar and Zambry from acting as MB in order to enable Nizar's suit seeking to set aside this order to be heard and decided then such a decision would have been acceptable.

But this order had made a mockery of the law and shattered the people's confidence in our judiciary. This is the reason why people have so little trust in the system of justice. This is why people despair when decisions are dished out by our courts.

We must be realistic and realise that ultimately the debacle and the dilemma confronting Perakians cannot be decided by the courts. The courts would only delay the outcome and prolong the uncertainties and provoke further political reactions endangering the peace and harmony enjoyed by the people for the last one year.

It is important to realise that this problem cannot be solved by the courts. Only two people can bring relief to this dangerous situation.

One of them is the Prime Minister who was implicated in causing this problem in Perak. He has stated that he wants to feel the pulse of the people so that he could be the people's PM. He must know what the feelings on the ground is.

The Senate President, the Chairman of Suhakam, MCA, Gerakan, eminent lawyers, concerned citizens, civil society and a host of prominent and caring individuals have called for the dissolution of the Perak State Assembly to overcome the present political stalemate in Perak.

He should heed these feelings and demands of the people and make a second trip to the palace and plead with His Royal Highness, the Sultan of Perak, to dissolve the Perak State Assembly. He cannot ignore this groundswell any longer if he lays any claim in wanting to be the people's PM. He must undo the present mess in Perak and restore stability in that state. He must rise above politics and act as a statesman in the interest of the country. This is one duty that he must perform as soon as possible with all sincerity.

The other personage who can definitely and incisively resolve the political turmoil and the upheaval in Perak is His Royal Highness, the Sultan of Perak. The sultan by now must know how angry and upset his subjects are that three unscrupulous politicians have subverted democracy and overturned a people's government by their unbecoming conduct. They have frustrated a duly elected government of the people and made nonsense of the democratic will of the people.

His Royal Highness must take cognizance of the sound and persuasive judgment of the High Court on 11 May 2009.

His Royal Highness must surely be aware that more suits filed in the courts will only delay and contribute to more frustrations; they need not necessarily mean more justice for this politically unresolved matter.

His Royal Highness must surely be aware that his subjects want a political settlement and it is they who must decide who should form their state government.

To enable the Perakians to solve this problem that has been festering like a sore wound for more than three months, please dissolve the Perak State Assembly.

There is no other way – no other solution.

There is no other solution except to dissolve the Perak State Assembly. I totally agree.

Go ahead......

I like this article from a blog and I need to copy and paste.

Quote:

Go ahead and burn the forest for a tree.

I wonder to myself; how is it possible for BN to be so short-sighted?

Why would BN rather win a battle and lose the war? The tactics used in trying to take over Perak only paint itself as a valiant in the eyes of the public. In fact it is a sheer undermining of the people’s intelligence, if it thinks that we are all too blind to see the injustices that have been going on.

7th of May will forever be marked as one of the most unforgettable day in the history of Malaysia- the Black Day of Malaysia. I’m sorry, Tun, but I think your hope that the people have short memory may not materialise after all. It has been 40 years since the “May 13”; yet, the tragedy still lingers in the mind of many, especially those who witnessed it.

The live video recording, photos and reports on how the drama unfolded will always remind us, Malaysians, of how our democracy was raped throughout the three months of political tussle in Perak. Oh, how disgusting and ugly the scenes were. It will forever remind us on how autonomous the police force, judiciary and civil servants had been (The crisis of confidence.)

Why had so many police being deployed on that day?
Why was Wong Chin Huat arrested just for calling people to wear black the day before?. Where was the threat ?
Why were there mass arrests on May 7th? Simply wearing black on that day or having breakfast at the mamak nearby the state secretariat did not warranted an arrest.
Why did the police go into the State Assembly hall and forcefully drag the speaker, YB Sivakumar out?
Why did the Sergeant in ?at Arm refuse to follow the Speaker’s instructions?
Why did the Assembly secretary Abdullah Antong Sabri have the audacity to sign the letter to announce for a State Assembly sitting on May 7th without the consent of the Speaker?

Oh well, maybe only part of the judiciary is independent, since YB Nizar was declared the rightful MB of Perak on May 11th by the Kuala Lumpur High Court judge Datuk Abdul Aziz Abd Rahim . I had initially thought that this might be the best way out for both PR and BN. Maybe.., just maybe… BN has finally come to its senses and realised how much this fiasco had damage its image. However, it can’t seem to see itself as being wrong for starting this whole episode in having Hee Yit Foong, Osman Jailu and Jamaluddin defecting from PR to be BN-friendly. I had thought that the High Court’s judgment was the best way to solve this mess so that a fresh SNAP election could be called to end this shameful episode of power grab.

But how wrong I was. Within the next 24 hours, the scenario had completely reversed. The Court of Appeal judge Datuk Ramli Ali, had granted Zambry a stay of execution of the High Court’s judgement. So, it was back to square one. It was really like a joke, to have one MB who had been declared true by the court, to go to his office, only to be surrounded by many police and FRU trucks, and the next day, was asked to vacate by the BN-elected MB because a stay of execution had been obtained! . This must be a joke for the whole world !

I was so wrong - BN has not learnt its lesson. It continues to self-destruct. Yes, go ahead and continue to wrestle PR for Perak. Go ahead and burn the forest just for a tree. The price will be expensive come the next general election, because the people will not forget what happened on Feb 4th, March 3rd and May 7th.

I was really hoping that our new and seemingly more intelligent PM would be able to show the strength of his character in solving the crisis in time of need, though he seemed to be the one who triggered the crisis, I was hoping that he could at least prove us wrong by making sound actions on this matter….. Now, he seemed to be passing the bug to the “MB”.

This saga has not come to an end as yet. The whole country and the whole world is watching. We are supposed to be a developed nation in not many years to come. I think we’ve been moving backwards instead!

Courts.

Terbalik Court: It happens in the game of “terup keling” (no offence to the Indian community). It is a foursome card game with two pairs of players each. When a pair thinks that they can win the round, they declared as court tani and if it is overturn, then it is terbalik court. I remember in the 50s and 60s the Sikh community used to play this game in the middle of roundabout in Ipoh. The last time I played this game was during an outdoor outing at Tasik Bera in 1991. I was pairing with my Director, Dato Ismayuddin and we make Zakaria & partner several “rumah batu”. Now I have forgotten several rules of the game and I need refresher course

Express Court: This only applies to UMNO Members when they want to appeal a judgment. For others got to wait for the Courts are having severe backlogged with unheard cases. At 0940 they filed the appeal, at 1100 the Judge sat and at 1300 verdict given. Mind you, it is all within the same day. I have two court cases pending for about ten years and still not resolved. One was a case against my staff for embezzlement and the other someone stole my antique Mercedes. I think the first one would be a gone case because the company I was with is now swallowed by another conglomerate. What upset me most for the second case I am tied with a RM 35,000 bond with Kerajaan Malaysia?

Shariah Court: Cases only involving Muslims, normally divorce and close proximity. If it involves celebrities, Malaysians would get the news in no time even televised. Single mother claiming for alimony would take several processes to clear. Sexual cases more often than not, the cases would be referred to Civil Court.

Communist Court: A very simple court but not that express. You are caught today, trial tomorrow, verdict delivered and the next day you face the firing squad. Chapter closed. You can face the firing squad even if you wrongly mix children milk formulae.

Malaysian Court: Sensitive cases you do not need to show your face in public. They will help to cover your face from day one to the day of sentence. The public would never know your look. Nobody knows they actually hang the actual person. If you are Muslim men, you can wear the songkok or the skull cap to show the world that you are God fearing men. Muslim ladies can wear the hijab maybe the purdah. If you belong to the Opposition parties, the hearing can be quickly convened. If you tag the line or if you are somebody you never get to the court for lack of evidence and no case.

Allah Court: This one no one can escape. You got scoot free in the world but up (down) there you got to answer. All part of your body will bear witness. If your sins does not equate with your good deeds He will locate you with tremendously hot air con room. If you are God fearing fellow, do what He ask and avoid misdeed, heavenly angels would surrounds you. This sentence is the ultimate and we have the choice of heaven on earth or heaven thereafter.

Getting there.

MU needs at least 4 points with three games in hand. Liverpool just behind the shoulders with two games in hand and incase MU falter, Liverpool would overtake MU to the finishing line. Early this morning MU played Wigan away at JJB Stadium. This game was closely monitored by MU fans as well as Liverpool.

MU sends in their strong strikers, Ronaldo, Rooney and Berbatov. The pitch was wet and slippery as it was raining and somehow MU game did not click. Their passes were not accurate and their targets went astray. Rooney missed an open goal and MU should be two up within the first fifteen minutes. MU back was a little bit flimsy without Ferdinand and Evan was often beaten on the break. On one of Wigan attack, Vidic slipped in front of the goalmouth and the ball landed into MU net. Wigan was one up till half time.

During the second half, Tevez was brought in and in no time he made a spectacular footwork in front of Wigan goal and put the ball in. Now it was level. With Tevez and Ryan Giggs joining in the team the flow of the game was more to MU. Carrick scored from a beautiful interchange started by Ronaldo on the right side. Now MU was up by 2 – 1 and the score remained. I am sure Liverpool hope was shattered. Three more points in the bag and MU just need one more from a home game with Arsenal and away with Hull.

I think it should be no problem and MU would retain the BPL Cup again for 2008/ 2009 season.

May 13.

Forty (40) years ago or four decade to this date the nation was shocked when the Malays and the Chinese was going after one another. Who started it is not important because the damage had been done and the road to recovery was a very long process. Up to this date the wound might healed but some scar to some, still remain.

My epilogue is only to relate and recollect where I was on that unfortunate day and the days after.

13th May 1969, I was working in Port Dickson with ESSO and was still a bachelor. I was only 23. On the evening of 13th.May, the PD beaches at Telok Kemang was crowded with visitors as the next day was the last Wednesday of the Muslim month of Safar. Those days Malaysian Muslims believed that having a dip in the sea or a good shower somewhere would cleanse all the bad luck. Now the tradition had been declared by Majlis Fatwa as forbidden (not practice by Muslims faith). Visitors or tourists by chartered busses thronged the beach and there was a stage show at the school field of Telok Kemang Malay Primary School. I went to watch the stage show with my housemate, late Hassan Amin in his Volkswagen. While we were watching the comedy act of S.M Salim, Jamal Kerdil and Ibrahim Din, S.M Salim told the crowd that he had to put a night in PD that night as it was impossible to go back to KL. He hinted that KL is having a small problem. We thought it was part of his comedy. Soon after, a Military Police car with a loud hailer came by and instructed all military personnel to report to the Garrison. Now we sensed something was not right and we rushed home. I switched on the television and Tengku Abdul Rahman was live on air detailing about the problem in KL and pleaded everyone to remain calm and remain indoor. TV was aired round the clock and we followed the development closely.

I have two brothers in KL, one attached to Pudu Jail and one at RTM. I was not bothered about the RTM guy because I saw him on air broadcasting the news bulletin and I managed to get the one of the Pudu Jail on the phone and apparently he and his wife took refuge at the most safest place in the jail.

Apparently I had taken one week annual leave and I was supposed to go back to Ipoh on 15th.May. The problem was I could not pass through KL because it was on 24 hours curfew. I called up MAS office in Melaka and I managed to get a seat from Melaka to Ipoh on 15th.May. The next, I called up Rest House Melaka for a room and there was plenty available. When I checked in at the Rest House, there was only one other occupant besides me. That guy was a Rothman Executive from KL and unable to proceed home. I did not sleep well because the situation was still tensed and the room was huge. On the 15th May morning I took the cab to Batu Berendam Airport and off I flew to Ipoh with a stopover at Subang Airport. That was my first experience flying in an airplane and it was Fokker Friendship. My parents were happy to see me back and I related to them that the KL brothers were safe and sound.

In Ipoh it was a night curfew and most of the time I was watching TV. One week later I went back to PD by road and the situation was under control. Back in PD, the night curfew was still on and for me who worked on shift; the mini bus would fetch me to and fro the Refiney.

The four bachelors in the house stocked canned food and bottled drinks. My housemate Zainuddin bought biscuits, bottle juice and several cans of lychee fruits. I remember Hassan and I played prank on him. We took the lychee can, cleanly open the bottom, consumed the content, cleaned the can and placed back on the dining table. Zainuddin found out the can was empty and the first suspect was me and of course I denied. Allah punished a sinner like me when I accidentally drank a kerosene from a bottle on the table which I thought was plain water. We all had a good laugh. The memory really touched me especially when Hassan had gone back to meet the Creator. At every May 13, I always remember, Hassan, Zainuddin and Lam Soo Keat, my other housemates whom I had lost touched. What I heard, he married a Thai and residing somewhere in Thailand.

Sometimes in July, situations were back to normal and night curfew was lifted. I could go to work normally and the people were slowly getting back to their senses. I have no problem with my Chinaman and Indian friends and we got along fine as it used to be even before May 13. In fact the bond became stronger because we were protecting each other. I remember my shift mates was Ho Kok Lin, Angamuthu, David Yek, Osman Ismail, Bernard Lim, Ghaffar Tamam and few others whose name I had forgotten. The shift superintendent was Yap Chee Meang and we nickname him as Tai So.

Malaysia……please no more of May 13. It doesn’t worth it. No one gain but a lot to loose. I dare not even want to talk about who started it and why it happened. It was a painful lesson to everybody. I believe in FREEDOM but sometimes freedom itself has its own boundaries.
